1. Services included
THE FOUNDATION FOR ACCESS TO RIGHTS, UIC: 176553638, provides on the territory of the Republic of Bulgaria free and paid intermediary services through the website www.refugeelight.bg ("the Site") to legal and natural persons with a valid registration in the Commercial Register - Employers.
The services include posting job offers upon request from Employers.
2. Contact person
In relation to their obligations under the General Data Protection Regulation ("Regulation (EU) 2016/679"), Employers need to provide a contact person for job applicants to contact on matters related to the protection of their personal data. The Employer is obliged to keep the contract details up to date at all times. This contact person, together with the Employer's identification information, shall be published publicly on the Site.
3. Provision of documents
FAR reserves the right to request additional documents, including signed (handwritten or electronic signature), to further identify the Employer and/or its Representative.
4. Authenticity of data provided
Employers are fully responsible for the accuracy of the data provided and are obliged to correct any inaccuracies immediately. In the event that this is not done immediately, FAR has the right to remove their job offers from the Site without notice.
5. Publication of job offers
5.1 FAR advertises and/or publishes job vacancies through the Site www.refugeelight.bg only in cases where there is an intermediary contract with the employer and in the presence of vacancies requested by the employer on the territory of the Republic of Bulgaria.
5.2 Employers are obliged by these General Terms and Conditions to provide job offers only for real and actual positions, and are not allowed to publish job offers that refer to jobs outside of Bulgaria.
5.3 Job offers cannot not be used to promote business opportunities, partnerships, products, services or websites, requirements to join social media pages, registrations, participation in games and/or pyramid schemes.
5.4 By these Terms and Conditions, Employers agree that Applicants are not required to purchase training or other services in any form.
5.5 Employers' information, documents and job offers may not contain:
(a) requirements of a discriminatory nature;
(b) content that violates or fails to respect the rights or legitimate interests of third parties, including fundamental human rights, intellectual property rights, etc.
(c) or any content that is unlawful, discriminatory, obscene, abusive, threatening, defamatory, hateful or indecent or that could embarrass or offend a third party.
5.6. By accepting these Terms and Conditions, the Employers grant FAR the right to make available and publish the job vacancies and to make the same publicly available, for which FAR shall not be liable for any remuneration.
5.7. FAR reserves the right to refuse, suspend or terminate the provision of Intermediary Services and to remove a job offer from the Site:
(a) in the event of unfair conduct by the Employer (e.g. providing false or misleading data and/or information; linking to competing sites, etc., etc.);
(b) in the event of a suspected breach of these Terms and Conditions or of the law;
(c) in the event of fees owed or not being paid on time, partially and/or in full.
5.8. In order to ensure reliability and security, FAR reserves the right to seek the assistance of the competent authorities in the event of gross violations of these Terms and Conditions and/or Bulgarian legislation.
6. Use of content
6.1. The Site and the content on the Site are the property of FAR. By accepting these Terms and Conditions, you may not use in any way, copy, modify or distribute any content from the Site that does not belong to you for any purpose other than or inconsistent with the intermediary services for hiring people in Bulgaria or any other purpose.
6.2. The published contacts of Employers and their Representatives may only be used for their intended purpose, i.e. in relation to applications for published job offers. You oblige not to use these contacts for any other reason, including but not limited to marketing and promotional purposes.
6.3. You are obliged not to interfere with the normal operation of the technical or software applications and computer systems of the Site or the users of the Site through any malicious acts.
7. Processing personal data
Issues relating to the processing of personal data in connection with the provision of the Services are governed by a separate Personal Data Processing Policy, which forms an integral part of these Terms and Conditions.
8. Financial Terms
8.1. The prices of the Paid Services for Employers shall be agreed upon signing an Intermediary Agreement.
8.2. In order for a job offer to be published on the Site by an employer, the agreed price must have been paid in advance.
8.3 Financial terms and prices may be amended by an additional Annex.
8.4. Employers are obliged to monitor and observe payment deadlines.
8.5. If the Employer wishes to discontinue the publication of their job offer on the Site, no refund will be made.
8.6 FAR reserves the right to refuse to publish a job offer if it does not comply with the Terms and Conditions at its discretion without prior notice.
9. Liability and Termination
9.1. In the event of default or non-payment of fees due, in whole or in part, FAR shall have the right to:
(a) restrict access to the Site;
(b) remove the job offer(s) from the Site without prior notice;
(c) terminate the Intermediary Agreement;
(d) simultaneously apply all of the above.
9.2 FAR may remove the job offer from the Site and/or terminate the contract upon:
(a) suspected violation of the law, these Terms and Conditions or any other terms and conditions set forth on the Site;
(b) upon your request as a party to the Intermediary Agreement.
9.3 FAR may terminate the Contract and/or remove a job offer from the Site:
(a) by notice in the event of termination of the Site;
(b) in other cases provided for in the General Terms and Conditions or by law.
9.4 FAR shall not be liable for any damages or loss of profits suffered by you or any third party as a result of compliance with any order of the competent governmental authorities.
9.5. Except in the case of intent or gross negligence, FAR shall not be liable for any damages or loss of profits incurred:
(a) as a result of the use or inability to use the Site;
(b) due to the restriction, termination or blocking of your job offer, if found to be in breach of these Terms and/or the law.
9.6. In all cases, FAR's liability in connection with any intermediary service provided on the Site is limited to the amount of the price paid by you.
10. Changes to the Terms and Services
10.1. FAR reserves the right to modify or remove existing Intermediary Services without notice to or permission of any party to an Intermediary Agreement.
10.2 Changes to the Terms and Conditions will not affect the provision of Intermediary Services paid for prior to the change.
10.3. In the event that you sign a new Contract or an Annex for intermediary services after the changes to the General Terms and Conditions have come into force, these changes shall be deemed binding on you.
11. Other conditions
11.1. In the event that any of the provisions of these Terms and Conditions prove to be invalid, this shall not invalidate the concluded contracts or other provisions.
11.2. The contract shall be concluded in Bulgarian or in Bulgarian and English. Disputes under these Terms and Conditions shall be resolved by the competent Bulgarian court.
11.3. The legislation of the Republic of Bulgaria shall apply to any unsettled matters.
